The Thailand Marine Department have made announcement 231 and 232 on 30 October 2020. This was due to the hard of the TYBA members (Thailand Yacht Business Association).

The guidelines for pleasure vessel (yachts) entering Thai waters
Pursuant to the Declaration of an Emergency Situation in all areas of the Kingdom
of Thailand issued on 25 March B.E. 2563 (2020) and the Regulations issued under Section 9
of the Emergency Decree on Public Administration in Emergency Situations B.E. 2548 (No. 1)
issued on 25 March B.E. 2563 (2020) by which the provisions of Clause 3 concerning the
closure of points of entry into the Kingdom: In using vehicles, whether aircrafts, vessels,
motor vehicles or any other types of conveyance, or using transportation routes, whether by
air, water, or land in order to enter into the Kingdom, the responsible officials shall close the
Points of Entry, checkpoints, border crossings or border checkpoints for passengers or
travelers entering into the Kingdom, in accordance with the laws on communicable disease
and immigration.
To be the accordance with Section 9 of the Emergency Decree on Public
Administration in Emergency Situations B.E. 2548 (No. 12) issue on 30 June B.E. 2563 (2020)
in the provisions of Clause 2 prescribed the competent officials or communicable disease
control oi°ficers shall supervise travelers entering into the Kingdom to strictly comply with
the conditions, timeframes and criteria determined by the government and shall order.
Persons who have been ordered or determined, as conditions for entry into the Kingdom,
shall be isolated, quarantined, or controlled for observation at a place and for a duration
specified by the government, or comply with the system for inspection of domestic travel or
the use of tracking applications to receive a disease diagnostic test when there is a reason to
suspect the infection of the disease, therefore, Marine Department has issued the Marine
Department announcement No. 53/2020 on Guidelines for ships entering Thai waters in
accordance with the Declaration of an Emergency Situation in all areas of the Kingdom of
Thailand issued on 31 March B.E. 2563 (2020).
Whereas, there was a provision issued under Section 9 of the Emergency Decree on
Public Administration in Emergency Situations B.E. 2548 (No. 13) dated July 31, 2010 and the
provision issued under Section 9 of the Emergency Decree on Public Administration
in Emergency Situations B.E. 2548 (No.14), dated 31 August B.E. 2563,( 2020). Which relaxed
the enforcement of measures to prevent the spread of infectious virus corona 2019(COVID – 19).
The Committee of The Centre for Covid-19 Situation Administration (CCSA)
held a meeting at 13/2563 on 21 October B.E. 2563 (2020) at the Office the National Security
Council, Government House, has agreed to allow the pleasure vessel (yachts) to enter the
Kingdom for tourism and to revive Thailand’s tourism economy. The Director-General of the
Marine Department, therefore, announced that ship operator, port operator, shipowner,
boat master, and passengers, operating in the event that there is an emergency declaration
in all areas throughout the Kingdom as follows.
- The following shall be added as (3) of Article 2 of the Marine Department
Notification No. 53/2563 regarding Guidelines for ships entering Thai waters in accordance
with the announcement of Emergency Situations in all areas throughout
the Kingdom, dated 31 March B.E. 2563 (2020).
“(3) pleasure vessel (yachts) that have followed the announcement of the Marine
Department’s231/ 2563 on the guideline on allowed process entering the Kingdom
of the group of vehicle control, crews, and passengers (by waterway) for pleasure vessel
(yachts) dated to October B.E. 2563 (2020). - Ship operator, ship-owner, master of a ship, of foreign ships shall screen
master, crew, passenger, and any person, and control such a person to do the following:- Prepare a document showing a vehicle operator or crews or passengers
along with specifying the time to enter the kingdom. - Prepare an insurance policy covering the expenses of health care
and medical treatment in the event of Coronavirus 2019 (COVID-19) or any other guarantee during their stay in the kingdom in the amount not less than 100,000 US dollars. - Prepare travel plans and identification documents before traveling
to Thailand. - Operate the vessel’s Automatic Identification System (AIS) at all times
in order to be able to track the vessel’s position from the country of origin to Thailand and
during quarantine inside the vessel at the anchorage point for a period of 14 days.
4) Record the body temperatures measurement of the crew two times a day from
the departure day trip to Thailand.
5) Application for permission to enter Thailand by tourists and crews according to
the guidelines of the Ministry of Foreign Affairs. In the event that the passenger or crew
is unable to request a medical certificate or perform a screening Coronavirus disease 2019
(COVID-19) from the port of origin, shall coordinate the hospital, contract party, agent to
proceed before submitting the application to enter the country.
6) Documentation of the contract of consent for quarantine on board or in any
areas under the supervision of The Chief Official responsible for remedying the emergency
situation not less than 14 days.
- Prepare a document showing a vehicle operator or crews or passengers
- When a ship under Article 1 arrives or stay in Thai waters, the ship operator,
ship-owner, master, shall proceed as follows:
(1) Screening for respiratory symptoms and measuring travelers‘ fever at the international gate
before entering the Kingdom (Entry screening) waterway (temporary)
to quarantine on board or in any areas under the supervision of The Chief Official responsible
for remedying the emergency situation not less than 14 days according to the preventive
measures and inhibit the spread of Coronavirus Disease 2019 (COVID-19).
(2) The Andaman Sea, using the Phuket Province area, Ao Por Bay area as an
international gateway before entering into the Kingdom (Entry screening), waterway
(temporary) under the responsibility of the Marine Department, Customs Department,
Immigration Department, Thai Maritime Law Enforcement Commanding Center region 3
(Thai-MECC 3), Disease Control Ofi‘ice and Animals and Plants Control Office.
(3) Gulf of Thailand, using the Chonburi Province area, the Ocean Marina
Yacht Club Port area as an international gateway before entering into the Kingdom
(Entry screening) waterway (temporary) under the responsibility of the
Marine Department, Customs Department, Immigration Department, Thai Maritime Law
Enforcement Commanding Center region 1 (Thai-MECC 1). Disease Control Office
and Animals and Plants Control Office-
(4) The delivery of supplies to the vessel can be done on the port and
the management of waste from the vessel shall be carried by the ship agent that has been
reviewed and approved by the contracted hospital.
(5) There shall be a COVID-19 test on board with RT-PCR method 3 times.
the first time on the day of the vessel entering Thailand (can omit the first time if there
is detection COVID-19 within 72 hours before entering the country) and the second time
between date 2-5 and third times between date 12-14 of the quarantine period
while docking or on a quarantined vessel operated by doctors from contracted
hospitals and vessel agents shall report the information to the relevant authorities.
(6) In the case of sending supplies, waste management, or having
staff up specimens collected by small boats shall use the proper protective equipment
and the boat shall be cleaned after every mission is completed.
(7) Observe the symptoms of passengers and crew according to the guidelines
of the Ministry of Public Health. When found to have abnormal symptoms shall proceed to
contact the contracted hospital for care.
(8) If found a person with a high risk, shall be treated by the contracted
hospital and coordinate to carry out an investigation and take care of the contacted person. - Expenses involved in the prophylaxis, disease testing, quarantine, and other
costs associated with bringing the vessel, tourist, and passengers into the Kingdom shall be
in the responsibility of ship operator, ship-owner, master, by operating through a ship agent
which can not claim from government agencies. - Passengers and crew are prohibited from leaving the vessel and any persons
are prohibited from boarding for a period of 14 days, except after 14 days of quarantine and
no COVID-19 infection is detected and relevant agencies already issued an approval
certificate.

Marine Department Announcement 232
Temporary mooring area for self-quarantine inside the pleasure vessel
(yachts) entering Thai waters.
The Center for COVID~19 Situation Administration (CCSA) a meeting
at 10/2563 on 21 October B.E. 2563 (2020) Office the National Security Council,
Government House has agreed to allow the pleasure vessel (yachts) to enter the Kingdom
for tourism and to revive Thailand’s tourism economy by the quarantine inside the vessel
not less than 14 days. It is therefore expedient to prescribe a guideline for the Marine
Department to enforce or order the pleasure vessel (yachts) entering such Thai waters,
move or relocate to any temporary moor for self-quarantine inside the vessel.
Therefore, by virtue of Section 3, paragraph thirty, together with Section 20 of the
Navigation in Thai Waters Act B.E. 2456 that provided foreign vessels on entering the port of
Thailand which is not defined as the port area. The master must report the entry or exit to
the port within twenty-four hours from the time of entry or before the ship departure and
must comply with the orders of the Marine Department, and in accordance with
Section 132 stipulated that every shipmaster must act in accordance with all reasonable
regulations and orders of the Marine Department to move the vessel to any place. The
Director-General of the Marine Department has issued the announcement as follows.
- Foreign pleasure vessel (yachts) which allowed to enter the Thai waters shall
proceed to moor in the area specified in article 2, article 3 or article 4. - Andaman Sea, Phuket Province Area, using Por Bay area, surrounding area with
radius of 500 meters of the following location.
Latitude 08 degrees 01 minutes 30 second North
Longitude 098 degrees 29 minutes 00 second East - Gulf of Thailand, Chonburi Province Area, using the Ocean Marina Yacht Club Port with
radius of 500 meters of the following location. –
Latitude 12 degrees 49 minutes 24 Second North
Longitude 100 degrees 54 minutes 06 Second East - Any other area as the Marine Department consider approve in the event that the
vessel can not moor in the area according to article 2 and article 3. - Characteristics of mooring in the area according to article 2, article 3 and article 4,
movement of vessels and any other relevant actions shall be in accordance with all
regulations and orders of the Marine Department. - Ship-owner, ship operator or Shipmaster shall control the passengers and
crew not to disembark and any person not to embark the vessel, except when the vessel
completed moor at the designated area for quarantine 14 days with undetected
infection COVID-19, and the relevant authorities has issued approval certificate.
